1. About these Terms

These Terms and Conditions (“Terms“) govern your use of the website ldscosmetics.com and any services provided by LDS Skin Cancer and Cosmetic Medicine (“LDS“, “we“, “us“, “our“). By accessing our website, booking an appointment or receiving any service from us, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our website or services.

2. About our practice

LDS Skin Cancer and Cosmetic Medicine is a medical practice led by Dr Lucas de Siqueira, a RACGP-fellowed medical practitioner registered with the Australian Health Practitioner Regulation Agency (AHPRA).

3.1 Information on this website is not medical advice

The content on ldscosmetics.com is provided for general information purposes only. It is not intended to replace professional medical advice, diagnosis or treatment. Always seek the advice of a qualified medical practitioner regarding any concerns about your health or proposed treatment.

3.2 Individual results vary

All medical and cosmetic procedures carry potential risks and outcomes that vary between individuals. Any information, images or descriptions of treatments on our website or marketing material reflect general expectations only and do not guarantee a specific result. Your suitability for a treatment, expected outcome and possible risks can only be assessed during a formal consultation.

3.3 Schedule 4 medicines

Some treatments offered at LDS, involve the use of prescription-only (Schedule 4) medicines. In accordance with the Therapeutic Goods Advertising Code, we do not name or promote specific Schedule 4 products on our website or in any advertising. These medicines may only be discussed and prescribed during a one-on-one consultation following a clinical assessment by Dr de Siqueira.

3.4 Cosmetic treatments are medical procedures

Cosmetic treatments performed at LDS are medical procedures. They carry potential risks including bruising, swelling, infection, allergic reaction and uncommon adverse events. Risks specific to your circumstances will be discussed in detail during your consultation. Informed written consent is required before any procedure.

4. Bookings, payments and cancellations

4.1 Booking appointments

Appointments may be booked online through our partner platform HotDoc, by phone, or in person. Booking an appointment indicates your acceptance of these Terms.

4.2 Deposits

Certain cosmetic procedures may require a deposit at the time of booking. Deposits are applied toward the final cost of the procedure. The deposit amount and conditions will be communicated to you at the time of booking.

4.3 Payment

Payment is due at the time of service unless otherwise agreed in writing. We accept major debit and credit cards. Where applicable, Medicare rebates will be processed at the time of payment for eligible services.

4.4 Cancellation and rescheduling

We require at least 24 hours’ notice for cancellation or rescheduling of appointments. Cancellations made with less than 24 hours’ notice, or failure to attend a scheduled appointment, may result in:

  • Forfeit of any deposit paid
  • A cancellation fee equivalent to the consultation fee
  • A requirement to prepay future appointments

We understand that emergencies happen. If you are unable to attend due to genuine illness or unavoidable circumstances, please contact us as soon as possible.

4.5 Refunds

Where a service has been provided, fees are non-refundable. This does not affect your rights under the Australian Consumer Law (see Section 7).

5. Consultation requirements

All cosmetic procedures involving Schedule 4 medicines require a face-to-face consultation with Dr de Siqueira before treatment can be administered. We do not provide diagnoses or prescribe medicines based on online enquiries, phone calls, or messages alone.

You must:

  • Provide accurate, complete information about your medical history, medications and allergies
  • Disclose any prior cosmetic treatments, especially in the same treatment area
  • Notify us if you are pregnant, breastfeeding, or planning a pregnancy
  • Read and sign the relevant consent forms before treatment

Withholding relevant medical information may affect the safety and outcome of your treatment and may result in us declining to proceed.

6. Third-party services and links

Our website may contain links to or use third-party services, including:

  • HotDoc for online appointment booking
  • Google Maps for location services
  • Social media platforms including Facebook and Instagram

These services have their own terms of use and privacy policies. We are not responsible for the practices or content of third-party providers.

7. Australian Consumer Law

Our services come with guarantees under the Australian Consumer Law that cannot be excluded. These include guarantees that services will be:

  • Provided with due care and skill
  • Fit for any specified purpose
  • Supplied within a reasonable time

To the maximum extent permitted by law, LDS’s liability for any breach of these guarantees is limited to the resupply of the relevant service or the payment of the cost of resupplying it.

8. Limitation of liability

To the maximum extent permitted by law:

  • We do not warrant that the information on our website is complete, current or free of errors
  • We are not liable for any indirect, incidental or consequential loss arising from your use of our website or services
  • Our total aggregate liability for any single claim is limited to the fees paid for the specific service giving rise to the claim

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including under the Australian Consumer Law.

9. Intellectual property

All content on ldscosmetics.com, including text, images, logos, designs and trademarks, is owned by LDS or licensed to us, and is protected by Australian and international intellectual property laws.

You may not reproduce, distribute, modify or republish any content from our website without our prior written consent, except for personal, non-commercial use.

10. Patient reviews and testimonials

In accordance with AHPRA’s Advertising Guidelines for Regulated Health Services, we do not use testimonials that refer to clinical aspects of treatment. 

11. User conduct

When using our website or communicating with our practice, you agree not to:

  • Use our services for any unlawful purpose
  • Provide false or misleading information
  • Harass, abuse or threaten any staff member or other patient
  • Attempt to gain unauthorised access to our website or systems
  • Use automated means to scrape, copy or extract content

We reserve the right to refuse service to any individual who breaches these conditions.

12. Governing law

These Terms are governed by the laws of the State of Victoria, Australia. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

We may update these Terms from time to time. The most current version will always be available on our website with the “Last updated” date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
